1. Acceptance of Terms

By accessing or using evotegh (“the Platform”, “we”, “us”), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, do not use the Platform.

These Terms apply to election organizers who register for an account. Separate instructions may apply to voters invited to participate in a specific election.

2. Description of Service

evotegh is an online election management platform that helps organizations create, manage, and conduct electronic voting. Our services include:

• Organizer accounts and election setup
• Voter registration, import, and invitation tools
• Secure ballot delivery and vote collection
• Results tabulation, analytics, and export options
• Optional features such as SMS two-factor authentication, vote receipts, and webhooks

3. User Accounts

To use the Platform as an organizer, you must register for an account with accurate information. You are responsible for:

• Keeping your login credentials confidential
• All activity that occurs under your account
• Notifying us promptly of any unauthorized access
• Maintaining a valid email address and, where required, phone number for security notifications

We may offer sign-in through email/password, Google, or Firebase authentication. Additional verification (such as SMS two-factor authentication) may be required before accessing your dashboard.

4. Credits & Pricing

The Platform uses a credit-based pricing model:

• Welcome credits: New organizer accounts receive 5 free credits upon registration.
• Usage: Credits are consumed when you add voters to an election (typically 1 credit per voter, depending on your plan and settings).
• Purchases: Additional credits may be purchased through credit packages displayed on the Platform, processed securely via Paystack.
• No hidden fees: Package prices and credit amounts are shown before payment.

Credits are non-transferable unless we explicitly agree otherwise in writing. Refunds for unused credits are handled according to our support policy and applicable consumer protection laws in Ghana.

5. Your Responsibilities

You agree to use the Platform only for lawful purposes. You must not:

• Conduct elections that violate applicable laws, regulations, or third-party rights
• Use the Platform to discriminate unlawfully or suppress legitimate participation
• Upload false voter data, spam contacts, or attempt to manipulate results
• Reverse engineer, disrupt, or overload the Platform
• Share voter credentials or bypass security controls

You are solely responsible for ensuring your election rules, eligibility criteria, and communications comply with your organization’s bylaws and local law.

6. Elections & Voters

As an organizer, you control election settings, voter lists, ballot content, and result visibility. You represent that you have a lawful basis to collect and process voter information you upload to the Platform.

Voters participate through invitations or registration links you provide. We design the Platform to protect ballot secrecy, but you must configure elections appropriately and communicate clearly with participants.

7. Data Privacy

We take data protection seriously. Our Privacy Policy explains what we collect, how we use it, and your rights. By using the Platform, you consent to those practices.

You are the data controller for voter information you upload; we act as a processor providing the technical infrastructure, subject to these Terms and our Privacy Policy.

8. Intellectual Property

The Platform, including its software, design, logos, documentation, and branding, is owned by evotegh and protected by applicable intellectual property laws. You receive a limited, non-exclusive license to use the Platform for its intended purpose while your account is active.

Content you upload (election names, candidate information, etc.) remains yours. You grant us a license to host, process, and display that content solely to provide the service.

9. Limitation of Liability

The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, evotegh shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

Our total liability for any claim relating to the Platform shall not exceed the amount you paid us in the twelve (12) months before the event giving rise to the claim.

10. Termination

We may suspend or terminate your account if you violate these Terms, pose a security risk, or if required by law. You may stop using the Platform at any time. Upon termination, your right to access the Platform ends, but provisions that should survive (including liability limits and governing law) will remain in effect.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of Ghana, without regard to conflict-of-law principles. Disputes shall be subject to the exclusive jurisdiction of the courts of Ghana, unless otherwise required by mandatory law.
